1. Acceptance of Terms

By accessing or using the PCEx Flexhub platform, website, or any of our logistics services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.

2. Description of Services

PCEx (Pacific Cargo Express) provides parcel delivery and logistics services across the Philippines. Our platform connects senders with a network of Business Partners (Flexhub Operators) — Hub Franchise Operators (HFO), Destination Franchise Operators (DFO/DFOPLUS), and City Franchise Operators (CFO) — who coordinate parcel pickup, inter-hub transit, and last-mile delivery.

Services include: shipment booking inquiries, real-time shipment tracking, operator management, and partner application processing. All booking inquiries submitted through our website require verification and confirmation by our team before becoming active shipments.

3. User Obligations

  • Provide accurate and complete information when submitting booking requests, partner applications, or contact forms.
  • Not use the platform for any unlawful, fraudulent, or harmful purpose.
  • Not attempt to gain unauthorized access to any part of the platform or its associated systems.
  • Not submit false shipment information or misrepresent cargo contents.
  • Comply with all applicable Philippine laws and regulations governing cargo transport.

4. Business Partner Terms

PCEx Business Partners (HFO, DFO, DFOPLUS, CFO) are independent franchise operators, not employees of PCEx. By applying and being approved as a Business Partner, you agree to:

  • Operate within the PCEx network guidelines, remittance structure, and commission schedule.
  • Maintain accurate shipment records and provide timely status updates for all parcels under your custody.
  • Complete physical onboarding at PCEx headquarters before beginning operations.
  • Keep your dashboard credentials confidential and notify PCEx immediately of any suspected unauthorized access.
  • Remit collected shipment fees to the appropriate party in the operator hierarchy within the agreed timeframe.

5. Limitation of Liability

PCEx shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to loss of parcel value, delivery delays due to force majeure events (natural disasters, government restrictions, road or weather conditions), or third-party service failures. Our maximum liability for any claim related to a specific shipment is limited to the declared value of the parcel as stated at the time of booking, not exceeding any applicable insurance coverage purchased.

6. Prohibited Cargo

The following items are strictly prohibited from shipment through PCEx:

  • Illegal substances, contraband, or controlled items under Philippine law
  • Explosives, flammable materials without proper documentation
  • Live animals without proper permits
  • Counterfeit goods or intellectual property violations
  • Any items prohibited by applicable law or regulation

7. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Albay, Philippines.

8. Changes to Terms

PCEx reserves the right to modify these terms at any time. Changes will be posted on this page with an updated date. Continued use of our services after changes constitutes acceptance of the revised terms.
